1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Operator", "you") and DIGISETU SERVICES PRIVATE LIMITED ("Company", "we", "us"), operating under the trade name Digi SetuSeva.
By creating an account, installing the application, or using the Digi SetuSeva platform ("Service") in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you are accepting these Terms on behalf of a Seva Kendra, business entity, or organization, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
Digi SetuSeva is an offline-first government-services management platform designed for Aadhaar Seva Kendra and Aaple Seva Kendra operators. The Service enables Operators to:
- Manage citizen service applications, documents, and records
- Generate bills, receipts, and financial reports
- Process document scanning and automated sorting
- Synchronize data across devices (optional cloud sync)
- Back up encrypted documents to cloud storage
The Service is available on Windows desktop (Electron), web browser, and Android (mobile) platforms. Core functionality operates fully offline using local storage; cloud features require an active internet connection.
3. Account Registration and Security
3.1 Eligibility
You must be at least 18 years of age and legally authorized to operate a government service center to use the Service. By registering, you represent that all information provided is accurate and complete.
3.2 Account Credentials
You are responsible for maintaining the confidentiality of your account credentials, including your password, recovery PIN, and any recovery cards issued to you. You agree to:
- Use a strong, unique password for your account
- Keep your recovery card in a secure physical location
- Not share your account credentials with unauthorized individuals
- Notify us immediately of any unauthorized access to your account
3.3 Account Responsibility
You are solely responsible for all activities that occur under your account. The Company is not liable for any loss or damage arising from unauthorized use of your account due to your failure to safeguard your credentials.
4. Subscription and Payment
4.1 Plans and Pricing
The Service is offered through subscription plans as described on our Pricing page. Prices are listed in Indian Rupees (INR) and may be updated from time to time with reasonable notice.
4.2 Billing
Subscription payments are processed through Razorpay, our authorized payment processor. By subscribing, you agree to Razorpay's terms of service. Subscriptions are billed on a recurring basis (monthly or annually, based on your selected plan).
4.3 Grace Period
If your subscription expires, a 7-day grace period is provided during which your account remains accessible. After the grace period, your account will be locked. Your data is not deleted — it will be restored upon subscription renewal.
4.4 Refunds
Refund requests are handled on a case-by-case basis. Contact us within 7 days of a charge if you believe it was made in error. No refunds are provided for partial billing periods.
5. Acceptable Use
You agree to use the Service only for lawful purposes. You shall not:
- Use the Service to process, store, or transmit data in violation of any applicable law, regulation, or government directive
- Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Service
- Circumvent, disable, or interfere with any security features of the Service, including encryption, access controls, or authentication mechanisms
- Share, resell, sublicense, or provide access to the Service to third parties without our written consent
- Use the Service in a manner that could damage, disable, or impair the Service or interfere with any other party's use
- Upload or transmit malicious code, viruses, or any harmful software through the Service
- Collect or harvest personal information of citizens for purposes unrelated to the legitimate government services you are authorized to provide
6. Data Ownership and Handling
6.1 Your Data
You retain full ownership of all data you enter into the Service, including citizen records, documents, application details, and financial records ("Your Data"). The Company does not claim any ownership rights over Your Data.
6.2 Operator as Data Controller
As an Operator, you are the data controller for the citizen information you manage through the Service. You are responsible for ensuring that your collection, use, and processing of citizen data complies with all applicable data protection laws and regulations, including but not limited to the Digital Personal Data Protection Act, 2023 (DPDP Act) and UIDAI regulations regarding Aadhaar data.
6.3 Company as Data Processor
The Company acts as a data processor, providing the technical infrastructure for you to manage citizen data securely. We process Your Data solely to provide the Service and do not use it for any other purpose.
6.4 Aadhaar Data
The Service stores Aadhaar numbers only as irreversible SHA-256 hashes for deduplication purposes. Raw Aadhaar numbers are never persisted in any database. You agree to handle Aadhaar data in accordance with UIDAI guidelines and the Aadhaar Act, 2016.
6.5 Data Portability and Deletion
You may export Your Data from the Service at any time. Upon account termination, you may request complete deletion of Your Data by contacting us. Local data stored on your device remains under your control.
6.6 Data Processing Agreement
A Data Processing Agreement (DPA) is available upon request for organizations that require a formal agreement governing the processing of personal data. Contact us at [email protected] to request a DPA.
7. Encryption and Security
The Service employs multi-layer encryption to protect sensitive data. While we implement industry-standard security measures (AES-256-GCM encryption, bcrypt password hashing, secure key management), you acknowledge that:
- No system is completely immune to security threats, and we cannot guarantee absolute security
- You are responsible for the physical security of devices running the Service
- Loss of your recovery card and all recovery methods may result in permanent loss of access to encrypted data — the Company cannot recover data encrypted with keys that have been irretrievably lost
- You must keep your device operating system and the Service application updated to benefit from the latest security patches
8. Cloud Synchronization and Backup
Cloud synchronization and backup features are optional. When enabled:
- Data is encrypted before transmission to cloud services (Supabase, Turso, AWS R2)
- Google Drive backup uses the drive.file scope, accessing only files created by the Service
- Cloud services are subject to their own terms and availability — we are not liable for outages or data loss caused by third-party cloud providers
- You may disconnect cloud services at any time through Operator Settings
9. Intellectual Property
The Service, including its source code, design, user interface, documentation, and all associated intellectual property, is owned by DIGISETU SERVICES PRIVATE LIMITED and is protected by copyright and other intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during the subscription period. This license does not grant you any rights to:
- Copy, modify, or distribute the Service or any part of it
- Use the Company's trademarks, logos, or branding without written permission
- Create derivative works based on the Service
10. Service Availability and Updates
10.1 Offline-First Design
The Service is designed to function fully offline. Core features — including citizen record management, document processing, billing, and receipt generation — do not require an internet connection. Cloud-dependent features (sync, backup, subscription verification) require connectivity.
10.2 Updates
We may release updates to the Service from time to time, including bug fixes, security patches, and new features. For desktop installations, updates are delivered through the auto-update mechanism. You agree to install security updates in a timely manner.
10.3 Service Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. In the event of discontinuation, we will provide at least 30 days' notice and assistance with data export.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied
- The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service
- Our total aggregate liability for any claims arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim
- The Company is not responsible for any loss of data resulting from device failure, loss of encryption keys, or circumstances beyond our reasonable control
12. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:
- Your use of the Service in violation of these Terms
- Your violation of any applicable law or regulation
- Your mishandling of citizen data or breach of data protection obligations
- Any dispute between you and a citizen whose data you manage through the Service
13. Termination
13.1 By You
You may terminate your account at any time by contacting us. Upon termination, your access to the Service will cease. Local data on your device remains accessible to you. Cloud data will be retained for 30 days to allow for data export, after which it will be permanently deleted.
13.2 By Us
We may suspend or terminate your account immediately if you:
- Violate these Terms or any applicable law
- Use the Service for fraudulent or illegal purposes
- Fail to pay subscription fees after the grace period
- Engage in activity that threatens the security or integrity of the Service
In cases of termination for cause, we will provide notice and an opportunity to export Your Data unless immediate termination is necessary to prevent harm.
14. Dispute Resolution
Any dispute arising out of or relating to these Terms shall be governed by and construed in accordance with the laws of India. The parties agree to first attempt to resolve any dispute through good-faith negotiation. If negotiation fails, the dispute shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
15. Changes to These Terms
We reserve the right to update these Terms from time to time. When we make material changes, we will notify you through the application and update the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
If you do not agree with the revised Terms, you must stop using the Service and contact us to terminate your account.
16. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service
- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect
- Waiver: The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision
- Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction
- Force Majeure: The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including natural disasters, government actions, or internet disruptions
